The Ellettsville, Indiana, Town Council met
in regular session at 7:30 p. m., Monday, November 25, 2002 at the Town
Hall. David Sorokoty called the meeting
to order and Ray Freetage led in prayer.
David Drake led in the Pledge of Allegiance.
Roll Call
David
Sorokoty asked for roll call of the Council Members.
Members present were David Sorokoty, President; David Drake,
Vice-President and Raymond Freetage.
Also present were Sandra Hash, Clerk-Treasurer, and Mike Spencer, Town
Attorney. Mike Cornman and Geraldine
McIntyre were absent.
Supervisors Present
Jim Davis, Jim Ragle, Deborah
Hudson, Mike Farmer and Jeff Farmer.
Jay Humphrey represented Ron McGlocklin, who was on vacation.
Approval of minutes of the meeting on November 11, 2002 and
special meeting on November 13, 2002
David Drake moved to approve the November
11, 2002 minutes. Ray Freetage
seconded. Motion carried. David Drake moved to approve the November 13th
minutes of the Hilly Hundred meeting. Ray Freetage seconded. Motion carried.
Action to pay Accounts Payable Vouchers
David Drake moved to approve the accounts
payable vouchers. Ray Freetage
seconded. Motion carried.
Resolutions
Resolution 18-02 Transfer of Funds
Sandra Hash explained the necessity for the transfers. Ray Freetage moved to accept Resolution
18-02 Transfer of funds. David Drake
seconded. Motion carried.
New Business
Jerry Presnell
concerning drainage problems in Deer Run Subdivision
Jerry Presnell lives at 804
Deer Run – he explained that every time it rains hard, the water all runs down
to the area near his home. He’s only
lived here approximately 2 years and this has happened 3 or 4 times
already. He said that the water is over
knee deep in some areas. Mr. Presnell
spoke to Mr. Robinson, the Developer and he told Mr. Presnell that it was the
Town’s problem because the Town’s Engineers had approved the project saying the
drainage was sufficient in that area.
He also spoke to Jim Ragle and he said it was the Developer’s problem. He presented pictures and asked who is
responsible for this problem. David
Sorokoty suggested hiring an attorney to get this fixed. Mike Spencer said the developer has the
responsibility. He also said that he
should speak to an attorney and find out the Statue of Limitations and get
advice on this situation. Jim Ragle
said he is in a low spot. Mr. Presnell
said that he would like the Town to have someone look to see if the Developer
followed the plans correctly when building the subdivision before he takes any
further action. David Drake suggested
having Rick Coppock take a look.
Rick Coppock called the
Clerk-Treasurer’s office today and he said he would look at the situation.
Komputrol Disaster
Recovery Plan for 2003
Sandra Hash stated this is an
annual agreement with the Town’s software provider. This agreement fulfills the
State Board of Accounts requirement for a Disaster Recovery Plan. If the Town Hall would experience a
disaster, such as a tornado we could access our information and work out of the
Komputrol main office located in Cicero, Indiana. Komputrol has provided the town’s software since 1999. We have actively participated in the
Disaster Recovery Plan for two years.
David Drake
moved to approve the Disaster
Recovery Plan. Ray Freetage
seconded. Motion carried.
Komputrol Annual
Maintenance Agreement
Sandra Hash informed the
Council this is also an annual agreement with the Town’s software provider,
which allows us to call their 800 number for assistance, as we need it, it also
provides us with any and all updates to keep the software current. Ray Freetage moved to accept the annual
maintenance agreement for Komputrol software systems. David Drake seconded.
Motion carried.
Fire Contract
between Ellettsville and Richland Township
Jim Davis, Fire Chief,
explained that the Fire Contract is the same as last year’s contract with a 5%
increase. David Drake made a motion to
approve the Fire contract between Ellettsville and Richland Township. Ray Freetage seconded. Motion carried.
Supervisor’s
Comments
Jim Ragle, Street Commissioner, expressed the need for new streetlights.
Greenbriar addition needs 3 lights on Cannon Court and 2 on Ironsides Drive.
The light on Ironsides will require an installation fee of $358.00 due to
additional wiring that must be done. The streetlights on Susan Street suffered
damage during the tornado. Five
fiberglass poles will be replaced with wooden poles. The wooden poles will result in a $4.00 savings per pole per
month. Cinergy requested a letter of
approval to have the streetlights installed.
Ray Freetage moved to accept the request for 10 new streetlights at
$6.99 each per month. David Drake
seconded. Motion carried.
Jim added that the Street Department paved Sycamore Drive at a cost of
approximately $14,000.00. Mr. Kain, Superintendent of the Richland
Bean Blossom Community School Corporation agreed that the school would
reimburse the Town for ½ of the cost.
Sandra Hash said reimbursement came in today’s mail.
Due to the tornado disaster, DLZ an Architectural Engineering and
Environmental Services Firm gave 250 pin oak trees to be distributed for free
to whoever would like them in the Town.
David Sorokoty, President, thanked the road crews for opening the new
section of State Road 46. He also
announced that the Hartstraight Road Bridge is open now as well.
